CONTRACT AGREEMENT

Dear prospective cat parents,

We are very happy that you are considering welcoming a kitten into your home.
Please remember that this decision is a lifelong commitment to the animal, requiring plenty of time, patience, and care.

Your kittens are currently growing and need special attention and care during this period to grow up healthy and happy in their new family.

We want to remind you that the physical and mental well-being of the animals is very important.

Regular vet visits, high-quality nutrition, and sufficient exercise should therefore always be ensured.

Your dedication will be rewarded many times over by your furry friends.

2. Subject of the Contract

2.1
The buyer acquires a kitten as owner and the seller sells the kitten to the buyer upon signing this contract at the purchase price specified below.

2.2
The kitten is acquired as a pet only.
The buyer expressly agrees not to breed with the kitten or make it available to others for breeding purposes.

2.3
A castration/spaying confirmation must be sent to the breeder unsolicited by the kitten’s 9th month of age at the latest.

2.4
If after purchase the buyer wishes to breed with a pet kitten — which includes even a single mating of this cat with another cat of the same breed with the aim of raising kittens — this must be coordinated with the breeder.
If the breeder permits this, the buyer agrees to pay an additional fee of €1500 (regardless of the purchase price) within 5 working days.
This entitles the buyer to advice and support in finding a mating partner and assistance with all questions regarding cat breeding from the seller.

2.5
If the above obligations are not or only partially fulfilled, a contractual penalty of €5,000 will be due.
Furthermore, the breeder (seller) has the right to reclaim the animal, as far as possible, without the buyer having any claim to a refund of the purchase price, including all papers belonging to the animal (pedigree, vaccination record).

3. Buyer’s Obligations

3.1
Animals are not objects but sentient beings capable of feeling and suffering, whose dignity is protected by law.
The buyer is aware of this and his/her high responsibility towards the animal and therefore accepts the following obligations:

3.2
The buyer agrees to keep and care for the cat properly and in an appropriate manner.
Furthermore, the animal must receive sufficient veterinary care (including regular vaccinations) and adequate and suitable activity opportunities (especially for indoor cats) and social contacts.

3.3
The buyer refrains from all abuse and cruelty to the animal and also does not tolerate such acts by third parties.

3.4
The buyer confirms that the animal is purchased only for themselves and not as an intermediary for others.

3.5
Not to be used for experimental purposes or further sold for such purposes.

3.6
Not to be sold to pet stores or professional animal traders.
The seller must be informed in writing immediately before any planned transfer and consent must be obtained.

3.7
The kitten/cat may not be given to an animal shelter or given away as a gift.

3.8
Changes of address must be communicated to the seller immediately and in writing without request.
If these points are not properly fulfilled or ignored, the buyer agrees to return the animal immediately to the breeder — without reimbursement of the purchase price — and the contract ends.

3.9
The decision to purchase an animal is a conscious and well-considered one.

3.10
The buyer assumes responsibility for the adaptation of the purchased animal to their household (with advisory support from the breeder), including the interests of family members, neighbors, relatives, other animals in the household, etc.

3.11
In case of problems not related to the health of the animal, the cat may be returned to “Ragdoll of Vienna Spirit” without refund of costs. This also applies in case of sudden allergy of the buyer or family members. Allergy tests should be conducted before purchase. The breeder always decides.

3.12
The breeder recommends continuing to feed the animal with ANIfit® products for at least 2 months.
Detailed advice from the breeder is always possible.
If a food change occurs, it may easily cause digestive irritation in the animal. The seller assumes no responsibility.
You will receive a 10% discount on your order from ANIfit®.

3.13
The buyer is aware that if the cat is allowed outdoor access or contact with other cats, there is an increased risk of infections such as parasites, fungal infections, Feline Infectious Peritonitis (FIP), or Feline Immunodeficiency Virus (FIV).
The seller assumes no responsibility for infectious diseases after handover.

3.14
In case of death, defects must be confirmed by a necropsy report from a competent veterinary authority.
No cash refund is given if the kitten contracted diseases during transportation or in the buyer’s area.

4. Handover and Health

4.1
The cat is at least 3 months old at handover. It is weaned and litter-trained.
The animal is vaccinated and comes with a veterinary pass listing all vaccinations.

4.2
The animal is healthy and free of fleas, ear mites, worms, and has appropriate behavioral development for its age. It is free of FIP and FeLV (Feline Leukemia Virus).

4.3
The breeder explains that pathogens such as Giardia, coccidia, gas-forming bacteria or other intestinal parasites occur in the environment and are not considered defects.
The buyer is informed that moving to a new home can cause stress that may lead to digestive issues such as diarrhea temporarily.

4.4
The breeder assures that no obvious defects or diseases (acquired or inherited) are known to them.
A veterinary health certificate is provided to the buyer.

4.5
By signing this agreement, the buyer confirms no visible signs of illness were present at purchase.

4.6
The one-week guarantee (from kitten’s move-in date) applies only to infections contracted from the breeder and requires the buyer to quarantine the kitten from contact with other animals for one week.
No changes to feeding, vaccination, deworming or other treatments may be made during this period without the breeder’s consent unless it is a medical emergency.
Otherwise, the breeder refuses all liability.

4.7
The breeder is not liable for hidden defects or diseases.
Claims for damages, rescission or reduction after handover are excluded.
Risk of health and growth changes passes to the buyer at handover.

4.8
No claims about the animal’s condition will be accepted after the warranty period (1 week).
The buyer may always contact the breeder for advice.
Only the breeder decides on examination of their cattery’s animals.

4.9
Please note: There is no 100% guarantee with living beings. Improper care can cause stress and negative effects on health and psyche.

4.10
The breeder is not responsible for health issues of the buyer’s other animals.
The buyer is aware of the need to quarantine newly acquired animals.

4.11
We recommend accident and health insurance for cats.
A health insurance is a good investment to ensure your pet is well cared for in case of illness or injury (e.g., AGILA).

5. Reservation

5.1
After paying a deposit of __________ €, the kitten is reserved and cannot be reserved by others.
After booking (binding reservation) and signing this agreement, the total price ___________ € cannot be changed.

5.2
This kitten is acquired without breeding rights. The class is defined as “PET”.

5.3
The purchase price is ___________ € and must be paid on handover day or transferred to arrive in time.

5.4
Handover date is agreed as ________________________________.

5.5
The buyer commits to collect the kitten before it reaches 3.5 months old.
If not collected by then, the breeder may sell it to another buyer.
In this case, the deposit is non-refundable.

5.6
Until full payment, the animal and its papers remain the property of the seller.

5.7
The buyer may refuse to buy or withdraw from the contract for any reason if the kitten’s development at handover is unsatisfactory.
The deposit is non-refundable.

5.8
If the animal is lost before handover, the breeder refunds the deposit fully, provided the kitten was still with the breeder.

5.9
If the animal is injured before handover affecting health or appearance, the breeder refunds the deposit fully, provided the kitten was still with the breeder.

5.10
The breeder reserves the right to cancel the contract without reason and refund the deposit within 14 working days.

5.11
From handover, full responsibility passes to the buyer.

6. Contract Withdrawal

6.1
If the buyer ever needs to part with the animal, the seller must be informed immediately and in writing. The seller has a right of first refusal and can take back the animal.

6.2
If the buyer wishes to resell the animal, the seller must respond within two weeks of written notification if they want to use their right of first refusal. If no response, consent is assumed.

6.3
If the seller does not want or cannot take back the animal, the buyer may place it elsewhere. The buyer must inform the seller of the new owner’s name and address.

6.4
The buyer commits not to give the animal to shelters, laboratories, pet shops or dealers.

7. Privacy Policy

7.1
Processing your personal data and your pet’s data by the seller is necessary to properly execute the contract and legally required data collection. Data will be deleted once no longer needed.

7.2
You have the right to access, correct, delete, restrict processing, or data portability of your personal data.
For this, contact the seller. You also have the right to complain to a supervisory authority.

8. Jurisdiction

8.1
For all current and future claims against a public legal entity or an entrepreneur acting in a professional capacity at contract signing, exclusive jurisdiction is the seller’s location, Vienna.
Austrian law applies exclusively.

8.2
The same jurisdiction applies if the buyer has no general jurisdiction in Austria, moves residence abroad after contract, or location is unknown at litigation. Otherwise, the buyer’s residence is jurisdiction. Austrian law applies.

9. Additional Agreements

The following oral side agreements are hereby recorded in writing and form part of the contract:

Later changes or additions to this contract require written form and express confirmation by both seller and buyer.
